Terms of Service

These Terms of Service ("Terms") govern access to and use of DeskQ (https://deskq.app), including our website, dashboards, APIs, operator iOS/Android app, and embeddable support widget (collectively, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

DeskQ lets operators create product-trained support desks: train from website content and knowledge you provide, embed a chat widget, generate AI answers, and open human handoff tickets by email. Features and plan limits are described on our pricing page and may change as we ship updates.

2. Accounts & eligibility

You must be at least 16 and able to form a binding contract. You are responsible for your account credentials, for activity under your account, and for keeping contact and billing information accurate. Notify us promptly of unauthorized use via our contact form. You can delete your account from the website or the operator app; that cancels paid subscriptions and starts a 30-day purge.

If you use the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.

3. Your content & end users

You retain ownership of content you upload or connect (sites, knowledge, FAQs, GitHub sources, chat logs you generate as an operator). You grant us a limited license to host, process, and display that content solely to provide and improve the Service.

You are responsible for your relationship with end users who chat with your desks, for lawful collection of their data, and for any notices or consents required in your jurisdiction. You must not use DeskQ to process content you do not have rights to use.

4. Acceptable use

You agree not to:

  • Violate any law or third-party rights
  • Probe, scan, or attack the Service; bypass rate limits or security
  • Use the Service to spam, phish, harass, or distribute malware
  • Resell raw access to the Service in a way that circumvents plan limits without our written consent
  • Submit unlawful, harmful, or infringing material as training data or chat content
  • Misrepresent that AI output is human-authored when disclosure is required

We may suspend or terminate accounts that abuse the Service or create risk for other customers.

5. AI output disclaimer

AI replies can be incomplete or incorrect. DeskQ is a support assistant, not legal, medical, or financial advice. You should review knowledge bases and critical answers. We do not guarantee continuous uptime of third-party model providers.

6. Plans, billing & refunds

Free plan: limited desks and AI replies (currently 1 desk and 100 replies/month unless we publish different limits). Paid plans (Growth, Pro, and any we add) are billed in advance via Stripe on a monthly cycle unless stated otherwise at checkout.

You authorize us (through Stripe) to charge the payment method on file for recurring fees. Taxes may apply. You can manage or cancel from the account billing portal on the website; cancellation takes effect at the end of the current paid period unless otherwise stated. The operator iOS/Android app does not sell subscriptions or digital goods — start free in the app, and upgrade or change plans at deskq.app/pricing. Fees already paid are non-refundable except where required by law or explicitly offered by us.

We may change prices with notice for the next billing cycle. Continued use after the change constitutes acceptance.

7. Intellectual property

The Service, including software, branding, and documentation, is owned by DeskQ and its licensors. Embed scripts and dashboard UI are licensed to you solely for use with your active DeskQ account. You may not reverse engineer, scrape non-public surfaces, or remove branding except where your plan expressly allows white-label options.

8. Third-party services

The Service integrates with third parties (e.g. Stripe, Resend, AI providers, hosting). Their terms and privacy policies apply to their processing. We are not responsible for outages or changes by those providers beyond our reasonable control.

9. Confidentiality

Non-public information exchanged in the course of support or enterprise discussions should be treated as confidential and used only for the relationship, except information that is public, independently developed, or required to be disclosed by law.

10. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESKQ AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100) IF YOU ARE ON A FREE PLAN.

12. Indemnity

You will defend and indemnify DeskQagainst claims arising from your content, your end users' use of your desks, your breach of these Terms, or your violation of law or third-party rights.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach, risk, non-payment, or if we discontinue the Service with reasonable notice when practical. Sections that by nature should survive (including IP, disclaimers, liability limits, and indemnity) survive termination.

14. Changes to the Terms

We may update these Terms. We will revise the "Last updated" date and may notify you by email or in-product notice for material changes. Continued use after the effective date constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, unless mandatory consumer protection law in your country of residence requires otherwise. Courts in California will have exclusive jurisdiction, subject to those mandatory rights.
